These Terms of Use (“Terms”) govern your use and access of the SafeKey Mobile application (“Application”, “SafeKey Mobile”, or “SafeKey Mobile App”). 

SafeKey Mobile is a SafeTech solution that enables you to securely store your Inheriti plan shares on a mobile device. Inheriti is a decentralized data protection solution for managing and transferring digital access data, also known as “Secret Data”, in a digital recovery or inheritance plan. Users, including owners, beneficiaries, and merge authorities of an Inheriti protection plan, may utilize either SafeKey Mobile or a SafeKey Pro hardware device to securely store their encrypted plan shares. 

SafeTech refers to SafeTech B.V. and its affiliated companies, including Safe Haven Tech PTE.LTD. (hereinafter referred to as “SafeTech” and “we”). SafeTech B.V. is the contract partner of these Terms with you as private or professional user (hereinafter referred to as “user” and “you”).

By accepting these Terms, you agree and accept to be bound by these Terms and meet all eligibility requirements that are outlined in these Terms. If you are using the Application for an organization or legal entity, you confirm that you are duly authorized by the organization or legal entity to act on its behalf and are accepting these Terms on behalf of that organization. 

We reserve the right to modify these Terms of Use at any time. Any modifications will come into effect on the communicated date. In the event of updates, we will inform you via email (based on your SafeID account) about the changes. The next time you login to the SafeKey Mobile App, you will be requested to confirm reading and accepting the updated Terms of Use. 

Former versions of the Terms of Use will be made available at the bottom of this page, including a registration of the history of changes.

Please read these Terms carefully and in conjunction with SafeKey Mobile’s Privacy Policy.

Eligibility

To be eligible to use the Application, you warrant that you are at least 18 years old and you confirm that you comply with all rules, regulations and laws that apply to your jurisdiction. You agree that you will not use this Application for any prohibited actions. We reserve the right to revoke or deny the use of the Application to any user who engages in activities that violate applicable laws, regulations, or our policies. This includes but is not limited to unlawful, fraudulent, or abusive behavior. We may take necessary actions, including termination of the user’s account, to protect our interests and maintain the integrity of the Application.

Use of SafeKey Mobile application

Subject to your compliance with these Terms, you are granted a revocable and non-exclusive permission to use the Application and/or other technical resources embedded in the Application within the scope and for the purposes of the Application. The scope of the SafeKey Mobile is the storing of Inheriti plan shares on a mobile device, including processes like claiming, storing and releasing the Inheriti plan shares to join a merging process of the connected Inheriti plan.

In order to access and utilize the Application, you agree to ensure that your device meets common technological and market standards and is kept up-to-date and secure. You are responsible for installing the latest updates for your operating system and applications. 

We reserve the right to release updates, fixes and further developments of the Application and/or its related software. Make sure you always use the latest update. You can check if you have the latest update in the menu in About SafeKey: Check for updates.

SafeKey Mobile is a web application and the use of the Application requires that you have access to the Internet. 

Term and Termination

This agreement becomes effective upon the user’s acceptance by opening the SafeKey Mobile Application for the first time. The agreement shall remain in effect until terminated by either party. The user may terminate the agreement at any time, by deleting the SafeKey Mobile App from his mobile device. The termination shall become effective immediately upon the deletion.

Downloading SafeKey Mobile

The SafeKey Mobile App can be downloaded in the App Store (for iOS users) and Google Play Store (for Android users). 

Account Registration: SafeID

To use your SafeKey Mobile App, you need to create a SafeID account. SafeID is an identity and access management solution which provides a secure one-time registration to gain access to multiple SafeTech services with a single username and password. 

The SafeID account is created by providing your email address and creating a password to register. Once your SafeID account registration is completed, you can use this email and password to login to the SafeKey Mobile App. The following Terms of Use and Privacy Policy apply to SafeID.

SafeTech does not have access to your SafeKey Mobile and SafeID account password. In the unfortunate situation that you lose your password, you can request on the SafeID Application for a reset of your password. Under no circumstances shall SafeTech be held liable for any loss of funds or damages, nor its employees, affiliates, partners or alike, should you lose the password to your account.

Please take note that when you delete your SafeID account, you no longer have access to the shares stored on your SafeKey Mobile App.  

SafeKey Mobile PIN code

First time you use the Applicaton you are asked to create a PIN code. You agree to maintain the security of your SafeKey Mobile PIN code in a safe place and you will be fully responsible for all usage of the SafeKey Mobile. 

We do not have access to your SafeKey Mobile App and PIN code. In the unfortunate situation that you lose your PIN code, you can go to Settings and Reset PIN code. Please take note that with resetting your PIN code you will need to download and store all inheriti plan shares to the SafeKey Mobile App again. Under no circumstances shall SafeTech be held liable for any loss of funds or damages, nor its employees, affiliates, partners or alike, should you lose the PIN code to your Inheriti Plan Shares.

Privacy Policy 

The use of the Application is subject to SafeID’s Privacy Policy. The Privacy Policy describes how SafeID collects, stores, and processes personal data. If you are subject to EU data protection laws and/or other data protection laws, you agree to follow and respect the terms of this law and others.

Acceptable Use

You represent and warrant, as a condition of use of the Application, that you will not use the Application for any purpose that is illegal, unlawful or prohibited. You shall not subject SafeTech to any spam, denial of service attacks, viruses or any action, activity or code that would interfere with the ordinary operation of the system. 

SafeTech reserves the right to take any appropriate measure to protect our legitimate interests including by denying you access to the Application, terminating contracts, reporting any misconduct performed through this Application to the competent authorities – such as judicial or administrative authorities – whenever you engage or are suspected to engage in any of the following activities:

  • violate laws, regulations and/or these Terms;
  • infringe any third-party rights;
  • considerably impair our legitimate interests;
  • offend us or any third-party.

You may not reproduce, duplicate, copy, sell, resell or exploit any portion of this Application and of its application without our express prior written permission, granted either directly or through a legitimate reselling program.

Intellectual Property

Any intellectual or industrial property rights, and any other exclusive rights on software or technical applications embedded in or related to the SafeKey Mobile are held by SafeTech and/or its licensors. SafeKey Mobile and its original content, features and functionality are protected by international copyright and other intellectual property or proprietary right laws to the fullest extent under Belgium and international laws.

SafeTech do not grant you any rights to access, usage or disclosure of the original source code. 

Without the prior written consent of SafeTech, you shall not use or permit any third-party to use any trademarks or trade names and no content of this Application may be copied, reproduced or duplicated in any form or by any means whatsoever.

If you give us feedback or suggestions on SafeKey Mobile through any communication method, we are allowed to use and share that feedback without any obligation or compensation to you. 

Access to External Resources

Through this Application you may have access to external resources provided by third-parties. You acknowledge and accept that SafeTech has no control over such resources and is therefore not responsible for their content and availability.

Conditions applicable to any resources provided by third-parties, including those applicable to any possible grant of rights in content, result from each such third-parties’ terms of use or, in the absence of those, applicable statutory law.

Service Interruption

To ensure the best possible service level, SafeTech reserves the right to interrupt the Application for maintenance, system updates or any other changes, informing you on the status page of the website: https://status.inheriti.com. Major service interruptions will also be reported on our social channels such as Telegram and Discord and users receive an email. 

The Application might not be available due to reasons outside our reasonable control, such as “force majeure” events, unforeseen events beyond our control, such as natural disasters, wars, government actions, infrastructural breakdowns or blackouts etc.

Service Continuity 

If SafeKey Mobile is involved in a future merger, acquisition, reorganization or sale, all rights and obligations will be transferred to the new owner. If your information is transferred as part of this, your data will be protected and handled in compliance with applicable data protection laws.

If the Application is discontinued, SafeTech will cooperate with the users to enable to withdraw personal data or information and we will respect your rights relating to continued service use and/or compensation, as provided for by applicable law. 

We will notify you via the email address associated with your SafeID account, of any such situation and outline it in detail.

Liability and Indemnification

You agree to defend, indemnify and hold SafeTech (or any natural or legal person acting on its behalf) harmless against any and all claims, demands, suits, losses, damages, expenses and liabilities, arising out of or relating to your violation of any of the Terms, the rights of any third-party, or your use of, or inability to use the Application. 

You agree to not hold SafeTech responsible for any damages that arise as a result of the loss of use, data, information or profits connected to the performance of the Application. To the maximum extent permitted by applicable law, we expressly disclaim all conditions, representations, and warranties — whether express, implied, statutory or otherwise, including, but not limited to, any implied warranty of fitness for a particular purpose, or non-infringement of third-party rights. 

All Secret Data is stored in an encrypted and fragmented format, making it impossible to be read when unintentionally released. SafeTech will not be held liable for any unintentional release of material resulting from a security failure, vulnerability, or force majeure event. 

Disclaimer of Warranties

By using our Application, the user acknowledges and agrees that we do not guarantee uninterrupted or error-free operation of the Application. We shall not be held liable for any damages, whether direct or indirect, resulting from any interruptions, delays, or disruptions in the services provided. This includes but is not limited to technical issues, internet connection failures, and maintenance downtime.

In addition, we do not provide any warranty or guarantee for the accuracy, completeness, or reliability of any information or content available on the Application. The user acknowledges and accepts that they use the Application at their own risk.

No advice or information, whether oral or written, obtained by you from SafeTech or through the Application will create any warranty not expressly stated in these Terms.

Waiver of Right of Withdrawal

The user acknowledges and agrees that no right of withdrawal exists for any products or services provided by SafeTech under these Terms.

No Waiver

The failure of SafeTech to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Severability

Should any provision of these Terms be deemed or become invalid or unenforceable under applicable law, the invalidity or unenforceability of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

EU Users. Should any provision of these Terms be deemed void, invalid or unenforceable, the parties shall do their best to find, in an amicable way, an agreement on valid and enforceable provisions thereby substituting the void, invalid or unenforceable parts. In case of failure to do so, the void, invalid or unenforceable provisions shall be replaced by the applicable statutory provisions, if so permitted or stated under the applicable law.

Without prejudice to the above, the nullity, invalidity or impossibility to enforce a particular provision of these Terms shall not nullify the entire Agreement, unless the severed provisions are essential to the Agreement, or of such importance that the parties would not have entered into the contract if they had known that the provision would not be valid, or in cases where the remaining provisions would translate into an unacceptable hardship on any of the parties.

US Users. Any such invalid or unenforceable provision will be interpreted, construed and reformed to the extent reasonably required to render it valid, enforceable and consistent with its original intent. These Terms constitute the entire agreement between you and SafeTech with respect to the subject matter hereof, and supersede all other communications, including but not limited to all prior agreements, between the parties with respect to such subject matter. These Terms will be enforced to the fullest extent permitted by law.

Customer Support

Inheriti Support provides different kind of customer support, including search and find, FAQ, tutorial videos and a live chat functionality, staffed during European working hours. 

It is also possible to send in a question via email. A request for support can be admitted via the Inheriti website. We aim to respond to support requests within 30 (thirty) days.

Complaint Procedure
To file a complaint, please send a detailed description to [email protected] and we will respond within 30 (thirty) business days. If necessary, we may request additional information to aid in our investigation. In certain situations, this deadline can be extended up to 3 (three) months, in that case you will be notified within 30 (thirty) days and informed of the reasons for the delay. The deadline to a complaint may be extended in the following situations: 

  1. Complex or numerous requests: In case of a complaint involving a substantial amount of personal data or intricate circumstances, we may require additional time to conduct a thorough assessment and provide a comprehensive response.
  2. High volume of requests: If we receive a high volume of complaints, we may encounter difficulties in meeting the standard 30-day deadline. In such cases the 3-month extension may be granted.
  3. Legal complexity: If the complaint involves legal considerations, such as a potential legal dispute or ongoing investigation, the deadline may be extended to allow for an adequate legal review.
  4. Involvement of multiple parties: If the complaint concerns multiple parties, an extended deadline may be necessary for gathering and reviewing information from each involved party. 
  5. Cooperation with other supervisory authorities: In cases where the complaint involves personal data processing activities that fall under the jurisdiction of multiple states / countries, the responsible organization may need to collaborate with other supervisory authorities. 

Efforts will be made towards amicable resolution of all complaints. In the event that such efforts prove unsuccessful, the matter will be addressed through a mutually agreed mediation process in accordance with the laws and regulations of Brussels, Belgium. Each party shall be responsible for half of the mediator’s fees. Litigation, if necessary, shall be subject to the laws and jurisdiction of Brussels, Belgium. The prevailing party shall be entitled to reasonable reimbursement of their attorney fees and other reasonable costs incurred in resolving the dispute.

Language

By accepting these terms and conditions, the user consents to all communication with SafeTech being conducted exclusively in English. This includes any customer support inquiries, notices, and updates related to the use of our applications or services. Any translations provided are for convenience only and the English version shall prevail in case of any discrepancies.

Entire Agreement

These Terms set forth the entire agreement for the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether, electronic, oral or written, between you and SafeTech.
